In General

Mindful Project is a nonprofit corporation and owns and operates this Website. This document governs your relationship with Mindful Project and mhagc.org (“Website”). Access to and use of this Website and the products and services available through this Website (collectively, the “Services”) are subject to the following terms, conditions, and notices (the “Terms of Service”). By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

This Website may contain links to other websites (the “Linked Sites”), which are not operated by Mindful Project. Mindful Project has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Prohibitions

You must not misuse this Website. Breaching this provision would constitute a criminal offense, and Mindful Project will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

Intellectual Property, Software, and Content

The intellectual property rights in all software and content (including photographic images) made available to you on or through this Website remain the property of Mindful Project or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Mindful Project and its licensors. You may store, print, and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute, or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website, nor may you use any such content in connection with any business or commercial enterprise.

Terms of Sale and Donation

In order to use mhagc.org, you must be 18 or operating under the supervision of your parent or legal guardian. By placing an order, you are offering to purchase a product or make a donation on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Any payments of donations are final and nonrefundable. You may choose to create a Donor Account but are not required to do so in order to donate.

Mindful Project is a non-profit corporation, tax-exempt under section 501(c)(3) of the Internal Revenue Code of the United States of America (US). Donations made in US Dollars by US taxpayers are tax-deductible to the full extent permitted by law. Our tax ID number will be included on your receipt for your donation. Event registrations are not eligible for deduction.

Images of items for donation, such as those for Operation Santa or Colors 4 Hope and all others, are for illustration purposes only and may not depict the actual items acquired with donated funds. By making a donation, you warrant that the mechanism you use (credit card or otherwise) is owned by you or you have permission to use it, and that there are sufficient funds to cover the cost of the goods or donation. When you make a donation, your donated funds are charged to your credit card and transferred to Mindful Project’s PayPal account. Purchases are charged and transferred in the same manner. Donations are made as unrestricted gifts and are not considered to be specified for any particular purpose, with the exception of donations made through the Funds 4 Hope portion of mhagc.org. Since Funds 4 Hope donations are specified for certain purposes, Mindful Project takes seriously your designation of how you wish your donated funds to be used and will make a good faith effort to use your donated funds as you direct, i.e., to buy socks, combs, color for Colors 4 Hope races and more, but may reallocate donated funds to the area or program of greatest need if necessary. As an example, if Operation Santa needs 400 pairs of socks and 400 combs, and the need for 400 pairs of socks is met, we may reallocate further funds donated for socks to be used to purchase other items, such as combs or deodorant, etc. Any such reallocated funds will be used with respect to our mission to promote positive mental health for all persons in our community through advocacy, education, and service. You as the donor pledge not to seek any reciprocal favors from Mindful Project, on the basis of your donation.

Colors 4 Hope merchandise purchased by race participants, such as additional T-shirts, color, etc., will be picked up by the participant on the day of the event at the race site. A complementary T-shirt and packet of color are included in the race packet which participants or their designated representatives pick up at a location to be announced, a day or days prior to the Colors 4 Hope race.

Colors 4 Hope merchandise and other merchandise purchased in the Funds 4 Hope portion of mhagc.org is subject to availability.
